Terms and conditions of sale

(i). Description

The company Marlène Venant EI, also known as Marlène Venant Languages Music (trade name), provides online foreign language lessons. It is located at N° 3, allée Santos Dumont, 33260 LA TESTE-DE-BUCH, in France.

The "Student(s)" corresponds to the beneficiary(ies) of Marlène Venant Languages Music's services.

The "Classes" correspond to all the services offered by Marlène Venant Languages Music to the Student as part of its teaching commitments.

The "Booking" corresponds to the commitment made by the Student and/or his/her legal representatives to take advantage of the Classes offered by Marlène Venant Languages Music in return for payment of the price.

(ii). Booking conditions

Any Booking for a class appearing in the online classes on the www.marlenevenantlanguagesmusic.com website implies prior consultation and acceptance of these general terms and conditions of sale.

The general terms and conditions of sale may be modified and/or updated at any time, however they are valid on the day the order is placed. Clicking to validate the order implies full acceptance of these terms and conditions. This "click" has the value of a digital signature.

Booking for Classes offered by Marlène Venant Languages Music are made by full payment, in advance, on the marlenevenantlanguagesmusic.com website. As soon as payment has been received, the customer will receive an e-mail confirming that the course has been booked.

(iii) Booking rules

Class booking may be made, at the earliest, 30 days before the class start time and, at the latest, 24 hours before the course start time.

Cancellations are permitted up to 24 hours before the class start time.

Reschedules can be made up to 72 hours before the class start time.

A waiting list is available for group classes when they are full. To access the list, you must be a Student member, i.e. have created a member space on the site. In their member space, students can access a waiting list of up to 8 participants. When a place becomes available, it is reserved for 1 hour for the first student on the list. If, at the end of the hour, the student has not made a reservation, the place is offered to the next student on the waiting list.

(iv). Age of Group Course Students

Marlène Venant Languages Music does not manage the age of Students in Group Lessons outside the "17 years+" and "11-16 years" categories. No preference regarding the age of students in a group Class can be taken into account in the booking schedule.

(v). Quality of internet connection

Marlène Venant Languages Music uses fibre optic to obtain a high-performance Internet connection and optimum interactivity. She is also equipped with Zoom software for smooth videoconferencing. However, Marlène Venant Languages Music cannot be held responsible for the inadequacy of a Student's Internet connection or the poor quality of the Student's equipment (microphone, headphones, speakers, computer, etc.) and cannot be held liable for any damages paid by Marlène Venant Languages Music.

(vi). Pricing

Class prices are quoted in euros and are exclusive of tax for European Union countries (VAT exemption, article 283-2 of the General Tax Code) and for non-EU countries. The prices indicated do not include the costs of processing the transaction.

The total price of the Booking is indicated in the basket.

Marlène Venant Languages Music reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of the Booking.

(vii). Terms of payment

Bookings for Classes offered by Marlène Venant Languages Music are made in full payment, in advance, on the marlenevenantlanguagesmusic.com website.  All payments must be made in euros by credit card or via the secure PayPal system. Bank charges for international payments are payable by the Student.

(viii). Cancellation and refund policy

(viii.i). A Student who has created a personal "My account" page has the option to Reschedule and Cancel, which allows him/her to make changes to a Booking within a minimum period of 24 hours. Marlène Venant Languages Music is required to refund the Student within 14 days of the date of cancellation.

A Student who has not created a "My account" page and who wishes to cancel a Booking must make the request at least 24 hours before the scheduled start time of the Class. To exercise his/her right to cancel, the Student must notify his/her intention to cancel a Class by e-mail to marlenevenantlanguagesmusic@gmail.com in an unambiguous manner, expressing his/her wish to withdraw.

Once this deadline has been met, Marlène Venant Languages Music is required to reimburse the Student within 14 days of the date of cancellation. 

(viii).ii. Refunds will only be made by bank transfer. For transfers outside the European Union, the corresponding bank charges and payment costs will be charged to the Student.

(viii).iii. If a Class is cancelled by Marlène Venant Languages Music, the Student will automatically receive a full refund of the sums paid to Marlène Venant Languages Music. In this case, the cancellation or postponement of a Class cannot give rise to the payment of damages by Marlène Venant Languages Music.

(viii).iv. Classes cancelled after they have started are non-refundable, except in the case of serious illness. In this case, the student must provide a medical certificate proving his/her inability to follow the Class.

(viii).v. Discipline: Marlène Venant Languages Music reserves the right to exclude from group Class any student who is rude or disrespectful to other students or to the teacher.

(ix). Waiver

Marlène Venant Languages Music's failure to invoke any of the present clauses at a given time shall not constitute a waiver of its right to invoke the same clauses at a later date.

(x). Sunset clause

In the event that certain clauses of these General Terms and Conditions of Sale should be null and void, this shall not affect the content or validity of the other provisions. The invalid provision should then be replaced by an applicable clause that comes as close as possible to the content and economic value of the original clause.

(xi). Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed solely by French law. In the event of a dispute arising between the auto entreprise and the Student(s), the search for an amicable solution will be preferred. Failing this, the matter will be brought before the French courts.
